Terms and Conditions
1. GENERAL
- These terms and conditions shall apply to all orders for the supply of goods in the UK whether by Orange Badge Mobility Services (hereafter known as The Supplier) or its Authorised Distributor or Agent.
- This order and these terms and conditions shall constitute the entire contract between The Supplier and The Customer.
- No variation to these terms and conditions by any employee or agent of The Supplier shall be effective unless notified in writing by a Principal of The Supplier.
- All orders are subject to acceptance by The Supplier.
2. TERMS OF PAYMENT
- In the case of cash sales, a cheque for the full order value will be paid. Cheques are payable to "Orange Badge Mobility" and sent to the address shown on the order form.
- In the case of sales financed by way of loan from a Finance Company, a deposit of up to 50% will be required at the discretion of the Finance Company. The goods will be delivered after the credit application has been approved, and any satisfaction notes or documentation required by the Finance Company must be signed.
3. GUARANTEES/WARRANTIES
- The goods purchased are guaranteed for twelve months from the date of delivery against faults arising due to defects in manufacture or materials. Parts replaced under this guarantee will be covered for the balance of the twelve month period.
- EXCLUSIONS
In the case of mobility vehicles/wheelchairs the guarantee does not cover tyres, inner tubes, punctures, belts, bulbs, upholstery, motor brushes, fuses or batteries or any other item that may need replacing due to normal wear and tear. - Batteries specifically are covered by a limited manufacturers guarantee subject to stringent wear and tear clauses. Any claim under this guarantee will only be settled if tests confirm that the fault occurred directly as a result of a defect in materials or manufacture.
4. DELIVERIES
The Supplier shall use its best endeavours to deliver within the period specified but will not be responsible for any delay due to situations beyond its control.
5. PASSING OF PROPERTY
Ownership of all goods sold shall remain the property of The Supplier until paid for.
6. VARIATION TO DESIGN/SPECIFICATION
- The Supplier reserves the right to vary or alter the design/specification of the goods ordered without notice and at any time prior to delivery.
- The Supplier undertakes not to lower the specification without adjusting the price accordingly.
7. CANCELLATION RIGHTS
The Supplier agrees to allow The Customer the right to cancel this order provided that such notice of the intention to cancel is received in writing (at the Suppliers address overleaf), within seven working days of the order being placed.
8. STATUTORY RIGHTS
These conditions do not affect your statutory rights.
